(1) カリビアンコム規約

本同意書では下記のとおり、契約者を「契約者」または「貴殿」と表記し、またCaribbeancom.comを「カリビアンコム」または「我々」と表記する。本同意書は、カリビアンコムより契約者に対しユーザIDならびにパスワードが発行された時点から有効となり、サービスに関するすべての料金も同様に、契約者に対しユーザIDならびにパスワードが発行された時点から起算される。

1. 法律および地域社会の規範に対する準拠
契約者は自らの居住する地域社会における風俗系メディアに関する規範・法律を理解し、カリビアンコムにおけるアダルト映像の送受信の閲覧がこうした規範・法律に違反しないことを言明する。また、契約者は本サイトの題材を要求、受信、処理することに関し、カリビアンコムに一切の責任がないことを言明し、本同意書の規約に同意する。

2.アダルトコンテンツ閲覧に関する同意
このウェブサイトは、アダルトまたはポルノに類される性的画像、言語、および音声へのアクセスを希望する成人（18歳以上もしくは居住する司法管轄権における成人年齢に達している個人）だけを対象に作成されたものである。本ウェブサイト内の題材には、裸体および性行為が描写されており、17歳以下もしくは居住する司法管轄権における成人年齢に達していない個人、またはこうした内容の表示を望まない成人は、これにアクセスしてはならない。メンバーシップを購入することで、契約者は以下のことを宣言し、その内容に同意する。「偽証罪告知の下、契約者は自分が18歳以上もしくは居住する司法管轄権における成人年齢に達しており、17歳以下もしくは居住する司法管轄権における成人年齢に達していない個人に対し、このウェブサイトに含まれる題材へのアクセスを禁止することを約束し、ここに宣誓する。契約者は、本ウェブサイトへのアクセスにより、アダルトまたはポルノに類される性的画像、言語、および音声が表示されることを理解し、自らの娯楽、情報収集、教育を目的に、本サイトに含まれるあらゆる題材の視聴を希望する。このサイトの閲覧は、契約者の住む地域社会における平均的成人個人が持つ健康的かつ一般的な性への関心・興味を表す行為である。契約者は自らの居住する地域社会におけるこのような性的題材の許容度をよく理解し、本サイトの題材が当該地域社会で許容されるものであるとみなす。契約者は、当該地域社会に居住する平均的成人が、未成年またはこうした題材の閲覧を希望しない成人に対してのアクセスを禁止するという状況下で、本サイトの題材を容認・消費し、また本サイトの題材を猥褻または不快と認識することがないと判断する。」

3.メンバーシップ料金
ウェブサイト（「サービス」と呼ぶ）が提供するサービス、情報および製品の使用を目的にした本サイトへのアクセスに対し、指定期間ごとにカリビアンコムのメンバーシップ料金が自動課金される。契約者がメンバーシップの解約手続きを行うまで、現行のメンバーシップ料金は指定クレジットカードに指定期間ごとに自動継続され、自動課金される。こうした売上げに対し返金は一切されない。なお、一度決済されたものに対する変更・取り消し・部分返金も一切されない。また、カリビアンコムは米国カリフォルニア州法に基づき運営されており、クーリングオフは受け付けないものとする。2008年5月20日より、ご登録頂きましたクレジットカードが何らかの理由により課金出来無かった場合、ご登録頂きました他のクレジットカードへ自動的に課金する、リカーリングシステムを実施する。

4.価格、コンテンツ、契約条件変更の権利
カリビアンコムは、価格、ウェブサイトのコンテンツ、およびこの契約条件のすべてを、いかなる時にも自由に変更する権利を有する。契約者は契約条件および価格に変更の有無を定期的に確認し、こうした変更が提示された後にカリビアンコムを継続使用した場合には、その変更を受け入れたものとみなされる。契約者へのサービスの均等化を計るため1日のダウンロード量は各サーバからダウンロードしたファイルサイズを総合した,4.0Gbyteに限られる。(超VIPメンバーは8.0Gbyte）

5.カリビアンコムによる強制退会およびサービスの一時停止
契約者がこの契約条件に違反した場合、または明らかにこれと矛盾する行動を取った場合、また理由のいかんを問わず、カリビアンコムはその自由裁量で、契約者あるいはあらゆる個人に対するサービスの中止、および/または一時停止する権利を有し、またこうした処分に対して、事前通知の義務を一切負わない。カリビアンコムは、契約者またはいかなる個人の本ウェブサイトへのアクセス権が取り消しまたは一時停止された場合にも、一切の責任を負わない。

6.契約者による退会
契約者がメンバーシップの取り消しを希望する場合には、必ずアカウントの更新日1週間前までに、サイト内に設置されている所定の解約フォームから退会届を提出しなければならない。

7.免責事項
カリビアンコムはサービスに関していかなる保証もせず、(1) サービスの可用性、サービスの正確性およびその内容、(2) 商品的確性または利用目的との適合性に対する保証から一切免責される。また、システムパフォーマンスの不具合、過失、省略、中断、削除、欠陥、倒壊による遅延、改ざん、または記録の使用（または記録への不正アクセス）に関するカリビアンコムおよびその幹部、取締役、従業員、代理人、独立系業者の責任は、それが契約や保証の違反、またはその他の不法行為に該当するか否かに関わらず、損害または被害の報告があった月に支払われたメンバーシップ料金を限度とする。なお、下記を含む顧客サービスは第三者であるAllbright Information Services, Inc. 社にて提供される（但しこれに限定されるものではない）:支払い請求への問い合わせ対応、不正請求の調査、商品の受注並びに配送サービス及びパスワード設定や再設定手配。従い、カリビアンコムはこのような第三者サービスプロバイダーの行為または不作為に対し一切責任を負わずまた、ユーザに対しいかなる責を負わないとする。

8.コンピュータのシステム要件
本ウェブサイトおよび「サービス」へのアクセスに必要なパソコン、テレコミュニケーション用機器およびインターネットアクセスは、すべて契約者の負担となる。画像のダウンロードが困難等の理由で「サービス」の完全使用が不可能な場合、また契約者のコンピュータや契約者が契約しているインターネット・サービスプロバイダーの性能に問題があって、こうした不具合が発生している場合、「サービス」に対し支払われた金額は一切返金されない。

9.ユーザIDおよびパスワード
「サービス」へのアクセスおよびその使用には、ユーザIDとパスワードが必要となる。セキュリティ保護のため、カリビアンコムでは、絶対にパスワードを公開しない。「サービス」への不正アクセスは本同意書の契約違反および法律違反となる。

10.提供情報の真実性
契約者は「サービス」の契約に必要な全ての情報を提供したことまたその内容が正しいことを保証する。この契約はいかなる個人または団体にも譲渡することは出来ない。また、「サービス」利用料金の支払いに使用しているクレジットカードの有効期限の変更、住所・請求先住所の変更、IDまたはパスワードの喪失、盗難、不正使用、不正公開など明らかなセキュリティ違反があった場合には、ただちにカリビアンコムに連絡しなければならない。「サービス」の不正使用により発生した損失・損害に関し、カリビアンコムは一切の責任を負わない。契約者が要求した場合、契約者は「サービス」の使用料金に関する請求記録へのアクセスが与えられる。

11.禁止行為契約者は
(1) カリビアンコムが所有・保有しているデータのコピー防止コードの解読、(2) 個人的利用目的以外での「サービス」上の題材の使用、(3) カリビアンコムまたは第三者の損失・損害を生むあるいはその原因となるような行為、(4) 契約者が居住する地域社会の風俗系メディアに関する法規や標準に違反する行為、(5) 公共のインターネット接続を妨害するような行為、(6) その他、カリビアンコムが不適切と定める全ての行為、など、カリビアンコムが定めている禁止行為を行ってはならない。

12.免責
契約者は契約者による本ウェブサイトの使用または不正使用に関わって、第三者から求められたあらゆる苦情、費用、要求（弁護士費用を含む）に関し、カリビアンコムおよびその幹部、取締役、従業員、代理人、独立系業者の責任を問わない。カリビアンコムは、契約者により免責されたいかなる懸案に関し、それを管理する権利および自らを守る権利を有する。問題への抗弁に関し、契約者はカリビアンコムに協力すること。

13.複製の禁止
公のドメインおよび電子メッセージを除き、「サービス」に表示される全ての題材には著作権が発生している。このため、カリビアンコムからの事前の書面による通知あるいは本同意書に明確にその旨が記載されている場合を除き、こうした題材の複製、再配信、またはダウンロードを禁止する。

14.私的使用
「サービス」上の題材は、私的かつ非商業目的で、契約者の娯楽のためだけに使用されるものであり、その他を目的とした使用は一切禁止する。

15.案内
カリビアンコムから契約者への案内は、カリビアンコムの一般掲示板への電子メールまたは郵便等で行われ、キャンペーン、特別セール、その他カリビアンコムおよび/またはカリビアンコムに関連するウェブサイトやビジネスの情報が提供される。また、貴殿がカリビアンコムへの入会を希望した場合、入会届の着信の有無を問わず、貴殿はカリビアンコムおよび/またはカリビアンコムに関連するウェブサイトやビジネスの情報提供の対象となる。貴殿から当社への連絡は、電子メール、郵便、または電話のいずれの方法でも行うことが出来る。

16.本同意書には、「サービス」の使用に関する契約者とカリビアンコム完全な了解事項を含み、かつ過去の書面または口頭による全ての了解事項に優先する。また改正は、カリビアンコムから契約者への告知を持ってのみ行われるものとする。明確に記述がある場合を除き、ここに書かれた条項は本同意書の満了まで有効とする。本同意書は、カリフォルニア州法に準拠する。

(2) D2Pass規約
D2Pass共通ネットワーク認証サービスシステムを利用される前に、本規約を必ずお読みください。

D2Pass共通ネットワーク認証サービスシステム（以下「D2Pass」又は「ネットワーク認証サービスシステム」と称します）とは、DTI Services, Inc.（以下「ＤＴＩ」または「当社」）が提供するサービスであり、 D2Pass加盟ウェブサイトへの登録、ログイン、および電子商取引の処理を簡単にするために用意された複数サイト認証サービスです。（以下「サービス」）

第1条　利用内容

D2Passサービスの利用は会員に限定されます。会員とは、18歳以上としてお住まいの地域または国における成人年齢に達しており、本サービスの提供に申し込みを行った上で本規約の遵守を約束し、会員登録をされた方を指します。

第2条　利用方法

ネットワーク認証サービスシステムを利用するためには、ネットワーク認証サービスシステム用の専用IDが必要になります。本規約第4条に従い、本規約第5条に規定された利用可能残高の範囲内で、D2Pass加盟ウェブサイト内にて取引、決済することができます。
D2Passは、月/年間会員制サービスを提供しており、固定料金制で特定サービスを利用することが出来ます。或いは、会員は、購入または利用されたサービスへの支払いのみをすることが出来ます。

第3条　メンバーシップ料金

2009年9月17日よりD2Pass プレミアムが提供するサービス、情報および製品の使用を目的にしたサイトへのアクセスに対し、指定期間ごとにD2Pass プレミアムのメンバーシップ料金が自動課金されます。月/年間会員制サービスを利用している会員がメンバーシップの解約手続きを行うまで、現行のメンバーシップ料金は指定クレジットカードに指定期間ごとに自動継続され、自動課金されます。こうした売上げに対し返金は一切されません。なお、一度決済されたものに対する変更・取り消し・部分返金も一切されません。また、D2Pass プレミアムは米国カリフォルニア州法に基づき運営されており、クーリングオフは受け付けないものとします。

第4条　決算システム

会員は、D2Passに加盟しているウェブサイトとの取引を決済するために、以下の要項に沿い、決済システムを利用することができます。

会員サービスサイトにログイン
D2Pass加盟ウェブサイトにアクセスし、希望する加盟ウェブサイトとの取引を選択する
D2Pass上の電子マネー利用限度残高を確認し、加盟ウェブサイト上での取引金額
(以下「利用額」)が、会員の利用可能残高の範囲内であることを確認
D2Passから加盟ウェブサイトの利用に必要な利用額を差し引く
2008年5月20日より、ご登録頂きましたクレジットカードが何らかの理由により課金出来無かった場合、ご登録頂きました他のクレジットカードへ自動的に課金する、リカーリングシステムを実施する。

2013年12月3日より、D2Passは、定期的に固定料金を課されるサービスに登録している会員を除いて、2年間使用されていない登録されているクレジットカード情報の一部、または全てを無効化し、会員のアカウントから削除いたします。無効化された後にサービスを購入または利用する際は、同じクレジットカードを再登録または別のクレジットカードを登録しなくてはなりません。

第5条　アカウント使用方法

会員は利用可能残高を確認、また、利用可能残高の範囲内で電子マネー決済システムを利用することができます。購入者が複数のアカウントを保有している場合には、その利用可能残高は、各アカウント毎に算定されます。但し、購入者は、各アカウント毎の利用可能残高を特定のアカウントに当社が定める一定額を上限として統合することが可能です。
D2Passは、ポイントプログラムまたはキャンペーンを行い特典付与を実施することがあります。D2Passは独自の判断により、こういったイベントを告知する場合があります。実施要領は、所定のサイトにおいて会員に告知します。ポイントの付与率、その他ポイント付与の条件は、当社が決定し、当社が予め定める所定のサイト（D2Pass、またはD2Pass 加盟サイト）において告知します。特典付与により加算されたポイントと、通常価格で購入し残高として残っていたポイントの合計は、小数点以下を四捨五入します。会員は、いかなる場合でもポイントを換金することはできません。
ポイントを一度商品と交換した後は、商品の返還並びににポイントの返還や他の商品、サービスなどとお取替えする事はできませんので予めご了承ください。
D2Passでは2010年5月27日より、現在使用可能なポイントが以下D2Pass加盟サイトにて共通利用できるサービスを開始する。（DXLIVE、カリビアンコムgirl、感熟ライブ）最新のポイント購入価格並びに各ポイント価格は各ウェブサイトのポイント購入ページをご覧下さい。

第6条　権利と責任

D2Passは、ユーザーＩＤ・パスワードを入力することによって利用されます。そのため、会員は登録されたユーザーID・アカウントに関連付けられたパスワードの機密性保持について責任を負います。会員は自分のユーザーIDを第三者に使用させてはなりません。会員のアカウントが、会員の同意なしに使用された場合またはD2Passのサービスが不正に使用された場合、会員は直ちに当社に連絡する必要があります。当社は、共通ネットワーク認証サービスアカウントの盗難、不正使用、紛失等に関しては、故意過失の有無にかかわらず一切責任を負いません。

第7条　禁止行為

D2Passのサービス提供を妨害するような行為
Spamといった受信側が送信を要求していない、あるいは、商業目的の大量な電子メールの送信または転送にD2Passを使用すること
第三者によるD2PassのユーザーID・パスワードの使用
D2Passのサービス規約やプライバシー・ポリシーに抵触する行為
未成年者による利用
第三者への迷惑になる行為
法律、法令、条令などに違反または抵触する行為

第8条　退会

利用者および当社のいずれも、当サービスの利用の取り消しをいつでも行なうことが出来るとする。また、会員が第7条に定める禁止事項に抵触する場合、または本規約に違反するような行為を行なった場合、会員はその会員権を喪失する。
会員が会員の地位を喪失した場合には、保有するポイント、特典との交換権、その他本サービスの利用に関する一切の権利を失うものとし、また地位の喪失にともなって当社に対して何らの請求権も保有しないものとします。
D2Passプレミアムのメンバーシップの取り消しを希望する場合は、必ずアカウントの更新日1週間前までに、サイト内に設置されている所定の解約フォームから退会届を提出しなければならない。D2Pass プレミアムを退会（会員期間終了）した際は、D2Pass プレミアムに含まれる各種サービスの利用も停止されます。詳細はサイトにて確認ください。その他サイトに関する質問は以下の問合せフォームより行なう事。https://service.d2pass.com/d2pguest/inquiry/

第9条　利用および通信に関して

会員は、当社が電子情報という形式にて個人情報やその他に関する通知、情報の開示、報告、書類の送付、通信を行うことに同意します。当社は、1)登録時に提供されたメール・アドレス、2) 当サービスにて作成されたメール・アドレス、3)該当サービスのウェブサイト上への提示、のいずれかの方法にて電子通知を行います。会員が実際にメールを受信したか否か、あるいは受信したメールを参照したかに関わらず、当社からの電子通知は配信された時点において通知されたとみなされます。会員は該当サービスの停止、アカウントの閉鎖を行なうことにより電子通知の受信を中止することが出来ます。

第10条　サービス利用責任

D2Passの加盟ウェブサイトにおける商品やサービスに対する支払い取引に関して、会員はすべての責任を単独で負うものとします。当社は、加盟ウェブサイトと会員間における取引の詳細にたいして一切責任を負いません。

第11条　不可抗力

アカウント保持者は、共通ネットワーク認証サービスシステムの保守、点検等のため、又は、天災、通信回線の故障その他のやむを得ない事情により、共通ネットワーク認証サービスシステムが一時的に利用できなくなる場合があることを了承するものとします。

第12条　追加、変更

当社は、全ての価格、ウェブサイトのコンテンツおよび本規約を含めて本サービスに新たなサービスを追加または変更する権利を留保し、会員はこれに同意するものとします。

第13条　免責

当社は、当ホームページに掲載される情報及びデータの内容、完全性、正確性、妥当性及び安全性などにおいていかなる保証をしないものとします。また、当社はこれらの情報を利用したことにより生じるいかなる損害についても責任を負わないとします。当ウェブサイトの使用により発生するリスクは、会員が負担する事とします。会員が当ウェブサイト上で、または当ウェブサイトを経由して使用または購入するすべての情報、コンテンツ、材料、製品、およびサービスに関しては、各製造者、販売者、供給者、およびプロバイダーが適用可能な保証を提供している場合に限り、その保証が適用されます。 D2PassおよびDTIは、当ウェブサイト上に含まれる、または会員が当ウェブサイト経由で入手できる情報、コンテンツ、材料、製品、またはサービスに関し、明示か暗黙かに関係なく一切の保証を提供せず、商品性および特定目的への適合性、並びに知的財産の侵害がないことに関する暗黙の保証を含めて、明示または暗黙のすべての保証を否認します。それらの情報、コンテンツ、材料、製品、およびサービスは、「現状のまま」「すべての欠陥を伴って」会員に提供されるものであり、製品またはサービスの品質、性能、正確性、および作用力の満足度に関するリスクはすべて会員が負担することになります。製造者、販売者、供給者、またはプロバイダーが（明示か暗黙かに関係なく）保証を提供している場合も、D2Pass およびDTIは、商品性および特定目的への適合性、並びに知的財産の侵害がないことに関する暗黙の保証を含めて、そうしたすべての保証を採用せず、尊重せず、それらを否認します。

第14条　責任の限度

いかなる状況において、またいかなる法理論（不法行為、契約、またはその他を含む）に基づいても、D2PassおよびDTIはいずれも、(i)会員による当ウェブサイト上の情報、コンテンツ、材料、製品、またはサービスの購入または使用に直接的または間接的に起因する、またはそれに関連して発生する、逸失利益、逸失所得、逸失事業機会、または人身傷害（死亡を含む）を含む、いかなる性質の直接的、間接的、偶発的、特別、懲戒的、懲罰的、または結果的な損失または損害（法務料金を含む）に関しても、(ii)会員またはその他の個人または組織による情報、コンテンツ、材料、製品、またはサービスの使用が第三者の著作権、特許権、商標権、企業秘密、機密、プライバシー、またはその他の知的財産権あるいは契約上の権利に対する侵害に当たるという主張に基づく主張、請求、訴訟、またはその他の法的手続に直接的または間接的に起因する、またはそれに関連して発生する、損失、請求、損害、経費、負債、または費用（法務料金を含む）に関しても、会員またはその他の個人または組織に対する責任を負いません。本規約、あるいは会員による当ウェブサイト上の情報、コンテンツ、材料、製品、またはサービスの購入または使用に起因または関連してD2Passまたは DTIが負う責任は、その情報、コンテンツ、材料、製品、またはサービスを購入するために会員が支払った金額を上限とするものになります。

第15条　　補償

会員は、会員による当ウェブサイトの使用、会員による当ウェブサイトへの接続、会員による使用条件違反、または会員による他者の権利の侵害に起因または関連して第三者により提起される、弁護士料金を含む請求、損失、または要求に関し、D2PassおよびDTI、並びにその両社の親会社、関連会社、子会社、役員、取締役、従業員、承継人、および譲受人に補償および免責を与えることに合意します。この補償条項は、本使用条件書の終了後も存続します。

第16条　　第三者へのリンク

当ウェブサイトには適宜、D2PassまたはDTI、あるいはその関連会社が所有、運営、または支配しているものでないウェブサイトへのリンクが含まれることがあります。このようなリンクはすべて、会員の便益だけを目的として提供されます。これらのリンクを使用した場合、会員は当ウェブサイトを離れることになります。他社サイト上に配置された、またはそこからアクセスできるコンテンツ、材料、情報、製品、またはサービスに関し、 D2PassおよびDTI、並びにその関連会社はいずれも責任を負いません。D2PassおよびDTI、並びにその関連会社はいずれも、他社サイト、あるいは他社サイト上に配置された、または他社サイトからアクセスできるコンテンツ、材料、情報、製品、またはサービス、あるいは会員が他社サイトを使用して入手する結果に関して、是認、約束、あるいは表示または保証を一切行いません。会員が当ウェブサイトからリンクされた他社サイトへのアクセスを決断する場合、それに関するリスクはすべて会員が負担することになります。

第17条　法律

本規約は、米国カリフォルニア州法が適用される。アカウントに関する、または当サービスの利用から生じた一切の紛争やクレームについては米国カリフォルニア州において認知される仲裁手続きにより解決されるものとします。仲裁を経て解決されない紛争やクレームは裁判にて解決されるものとし、その場合、米国カリフォルニア州地方裁判所を第一審の専属管轄裁判所とします。仲裁・裁判に関する弁護士費用は各当事者の負担とします。
本規約の条項が裁判所により無効あるいは施行不能とされた場合でも、当該条項以外の内容を有効とし、適応されるものとします。

MEMBERSHIP AGREEMENT

As used herein, subscriber shall be referred to as "Subscriber" or "you" and caribbeancom.com as "Caribbeancom.com" or "we." This Agreement will take effect when a user ID and password is issued to Subscriber by Caribbeancom.com. Accordingly, all charges for the Service shall commence upon issuance of the user ID and password to Subscriber.

1. Compliance with Laws and Community Standards. You are familiar with and understand the standards and laws of the community in which you live regarding sexually oriented media. You represent that, based on your familiarity with these standards and laws of your community, by requesting and receiving any of the adult material on Caribbeancom.com; you will not be violating any of these standards and/or laws. You understand that by accepting the terms of this Agreement, you will hold Caribbeancom.com harmless from and against any responsibilities related to your requesting, receiving or possessing materials contained on its site.

2. Agreement to View Adult Material. This website is designed and intended SOLELY for ADULTS - people who are at least 18 years old (or the legal age of majority in the jurisdiction in which you reside)-- who are interested in and wish to have access to visual images, verbal descriptions and audio sounds of a sexually oriented, frankly erotic nature. The materials which are available within this website may include graphic visual depictions and descriptions of nudity and sexual activity and should NOT be accessed by anyone who is younger than 18 years old (or the age of legal majority in the jurisdiction in which you reside) or who does not wish to be exposed to such materials. You understand and agree that no warranty is made by Caribbeancom.com regarding the Service, and Caribbeancom.com hereby expressly disclaims: (1) any and all warranties as to the availability, accuracy or content of available through the Service; and (2) any warranties of merchantability or fitness for a particular purpose. Accordingly, Caribbeancom.com is not responsible, or in any way liable to users, for the actions or inactions of this third party service provider.

Furthermore you hereby acknowledge and accept that by submitting a request for membership to CARIBBEANCOM.COM, whether the submission is successful or unsuccessful, that You are subject to receiving such Notices from CARIBBEANCOM.COM, and/or any other website(s) or business(s) affiliated with CARIBBEANCOM.COM.
